Artifocial Website Terms

Website terms, not a product contract
These terms cover the public website, content, newsletter, waitlists, and readiness scan. Alarmly has separate product terms. A Foundry pilot, installation, or paid engagement requires a separate signed agreement before delivery begins.
1. Agreement and scope
These Website Terms apply when you access or use artifocial.com, its articles and videos, newsletter and waitlist forms, the Agent-Native Readiness Scan, and other public website features (the “Website”). If you do not agree, do not use the Website.
More specific terms apply to products and control if they conflict with these terms:
- Alarmly Terms of Service for the Alarmly app and web experience.
- Foundry Pre-Launch Terms for Foundry requests, walkthroughs, and the readiness scan.
2. Eligibility
The general Website is for people age 13 or older. If you are under the age of legal majority where you live, use it only with permission from a parent or legal guardian. Foundry forms and commercial interactions are for adults age 18 or older who may act for themselves or the organization they represent.
3. What the Website provides
Artifocial publishes research, educational material, product information, and interactive tools. Some material describes experiments, prototypes, beta or pre-release software, or work in progress. Availability, features, timing, and pricing can change before a separate product agreement is signed.
A waitlist submission, scan result, walkthrough request, or product description is not an offer, guarantee of access, promise of a delivery date, or commitment to provide a paid service. We may accept, decline, or stop pre-release access at any time.
4. Educational and generated information
Website content and scan results are provided for general informational and educational purposes. They are not legal, financial, medical, security, employment, or other professional advice. Estimates are based on the answers and assumptions shown to you and may not reflect your actual costs, savings, readiness, or results. Verify important information and use qualified professionals where appropriate.
5. Acceptable use
You may not use the Website to:
- violate law or another person's rights, privacy, or intellectual property;
- submit deceptive, fraudulent, abusive, harassing, or unlawful material;
- probe, bypass, disable, or interfere with security, rate limits, or access controls;
- introduce malware or use the Website to distribute spam;
- impersonate another person or misrepresent your authority to act for an organization;
- scrape, copy, or automate access in a way that materially burdens the Website or ignores technical restrictions; or
- reverse engineer non-public Website functionality except where applicable law forbids that restriction.
We may restrict access or remove submissions when reasonably necessary to protect the Website, other people, or our rights, or to comply with law.
6. Artifocial content and intellectual property
The Website, its original text, graphics, branding, software, and organization are owned by Artifocial or its licensors and are protected by applicable intellectual-property laws. You may link to public pages and quote brief portions for commentary or other uses allowed by law, with attribution. These terms do not transfer ownership or grant a right to use our trademarks, private materials, or software outside an applicable license.
7. Information and feedback you submit
You remain responsible for information you submit and represent that you have the right to provide it. Do not submit confidential customer data, production credentials, personal data you are not authorized to share, or material that violates another person's rights through a public form.
If you voluntarily send an idea or suggestion, you allow us to evaluate and use it without an obligation to compensate you. This does not give us ownership of your personal information or confidential material, which remains subject to the Privacy Notice and any separate written agreement.
8. Third-party services and links
The Website can link to or rely on services operated by others. Their services are governed by their own terms and privacy practices. A link does not mean we endorse every statement, product, or practice on the destination. We are not responsible for third-party services outside our control.
9. Privacy
Our Privacy Notice explains how the Website handles information. Product-specific notices provide additional detail for Alarmly and Foundry.
10. Availability and changes
We may change, suspend, or discontinue Website features. We do not promise that the Website will always be available, error-free, secure, or complete. We will make reasonable efforts to keep public descriptions aligned with what is actually available.
11. Disclaimers
To the maximum extent permitted by applicable law, the Website and its content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty arising from course of dealing or usage. Nothing in these terms excludes a warranty or right that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Artifocial will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity, arising from the public Website or reliance on its informational content. These limits do not apply where liability cannot legally be limited. No fixed monetary cap or governing-law forum is stated here while the operating legal entity is being finalized.
13. Resolving concerns
Contact info@artifocial.com first if you believe the Website infringes your rights, contains an error, or has caused a dispute. This informal contact request does not waive any non-waivable legal right or deadline.
14. Changes to these terms
We may update these terms as the Website changes. The date above shows the latest revision. Material changes apply prospectively, and we will provide additional notice or obtain affirmative agreement when the nature of a service or applicable law requires it.
15. Provider information
These interim terms are provided by Artifocial, the public brand operating this Website. Our registered legal entity name, formation jurisdiction, mailing address, governing law, and venue will be added before paid Foundry contracting. Questions may be sent to info@artifocial.com.
